Will a sympathetic judge delay Nicole Richie's mandatory jail sentence if she's convicted? Don't get your hopes up, honey.

TMZ did some checking on the guy in the robe who will preside over her case and sentence her if she's convicted. The guy is Los Angeles County Commissioner Steven Lubell. The legal eagles who have appeared in his courtroom say he's tough and very much by the book. He will not give Richie any special treatment, and our sources say her pregnancy won't amount to squat when it comes to serving time.

Richie's trial is scheduled to begin next Wednesday. If convicted, it will be her second DUI and she'll face a minimum of five days in jail.

I don't get half of these comments. Surprisingly, people with troubled pasts and troubled lives can be good parents and you can't judge someone's parental skills based on tabloid gossip and TV shows.

^I understand what you are saying, but Nicole was arrested less than a year ago. Even if she has been clean ever since that day (which I highly doubt since that email for memorial day talked about drinking) she still hasn't had her life together for long enough to really say, to me at least, that she has gotten her life on track and is ready for children.

At this point I think she will definitely serve some amount of jail time...the public has about as much sympathy for her as Paris Hilton so...she's toast.

Even though she will play up that pregnant belly next week in court...the only one who may be safe from jail is Lindsay because it's her first offense but the DA could easily bring up felony charges...

Oh yes ...but I suppose females in Hollywood have always been wild...it's just that during the studio contract days...the big studio heads hid all their scandals.

I mean Elizabeth Taylor was already on her 2nd marriage at Lindsay's age with 2 kids and she was an alcoholic/pill popper...Ava Gardner...wild...the list goes on...

Well she's 12 weeks...so she has about 6 more months to go. Usually women wait until after 3 months to announce because the risk of miscarriage lowers by a lot...
