MADONNA has found her new clothing line, Material Girl, the subject of a lawsuit - brought about by California clothing company LA Triumph last Thursday, who claim it had been using the name since 1997.

Madonna's line, which she collaborated on with her 13-year-old daughter Lourdes, went on sale in Macy's just two weeks ago.

LA Triumph reportedly said that it has been "continually selling similar clothes in similar retail outlets at similar price points under the Material Girl brand since at least 1997, and Madonna and her new-found company do not have the right to trade in the same space under this brand".

According to Reuters, LA Triumph wants the judge to rule that the use of "Material Girl" creates "deception" in the marketplace. It is also asking that all profits from Madonna's line and company be given to them.

Neither a spokesperson for Madonna or Macy's has yet commented.

Just 2 weeks after release and Madonna is already getting her as$ kicked.

Well it was bound to have some issue's when Taylor Momsen was in their ad's.. (just saying).
 
All publicity is good publicity. Let's face it, Madonna has the financial might to buy out the other people if she wants, so I'm sure she's not especially concerned. I expect she'll thumb her nose at them for as long as it's possible and get the free press for as long as possible, then change the name at the eleventh hour. From the start she probably already knew somebody else owned and was using the name but just didn't give a toss about it.. I can imagine her being told that, and her saying, "well what are they gonna do about it?!" It's about time somebody said no to Madonna! :lol::rolleyes:
 
I'm baffled why she didn't trademark "material girl" (like Don McLean trademarked "American Pie" and made a mint from the films) years ago.
