Jamie Lynn Spears is Pregnant...For Real!*Update* It's a Girl

Last night they were talking about it on the radio and apparently FOX news said that Casey was in a tough spot over statutory r*pe.

TMZ has learned that Jamie Lynn Spears was not paid for this week's magazine interview ... yet. We're told the money will change hands down the road -- when the baby is born.

Just how did the deal go down? Rewind. Sources close to Britney's family tell TMZ it all started when Britney melted down on an OK! Magazine photo shoot. Britney's mom, Lynne, read the article (who didn't?!) and called OK! personally to thank them "for handling it so well." She stayed in touch with OK!, and called them this week when she learned that news of Jamie's pregnancy was about to break. Her only requirement? Keep Britney out of it. This is about Jamie Lynn. "She trusted them to do it in a way that would be sympathetic to her daughter," our source says.

We're told Jamie and mom did not want money, but OK! has agreed to pay $1 million to the younger Spears for a photo shoot when the child is born. Why so little when others have commanded several million? We're told it's because Jamie Lynn is not an international star and it's not worth it to the mag to pay big bucks for something they can't sell overseas.

Another interesting note: We hear Jamie is further along than the 12 weeks she says in the mag's article. Expect a spring baby.

(CNN) -- The announced pregnancy of Jamie Lynn Spears -- the 16-year-old children's television star and younger sister of beleaguered pop star Britney Spears -- is casting new light on how states deal with the thorny issue of consensual sex among teens.

Spears, the star of Nickelodeon's "Zoey 101," told OK! Magazine that she's pregnant and that the father is her 18-year-old boyfriend.

There has been no public talk of criminal prosecution in the case. Consensual sex between the two may well have been legal, depending on where and when it took place.

But critics of the nation's statutory r*pe laws say that laws that are ignored in some cases can be used to put other teens in prison and land them on sex-offender registries.

"You have a disturbing disparity in how these laws are enforced," said Jonathan Turley, a law professor at George Washington University. "I have no problem at all with nailing adults who sleep with children, but I have a problem with the prosecution of teenagers in consensual relationships.

In Louisiana, where Spears lives, it is a misdemeanor for someone age 17 to 19 to have consensual sex with someone age 15 to 17 if the difference between their ages is more than two years.

In California, where she sometimes tapes her television show, it's a misdemeanor to have sex with someone younger than 18 if the offender is less than three years older. Someone more than three years older could be charged with a felony.


According to OK! Magazine, which first reported the news Tuesday, Spears said the father of her baby is longtime boyfriend Casey Aldridge.

Turley said most states have similar laws but rely on prosecutors to be selective in enforcing them. But that's a recipe for legal problems, he said.

The issue drew international attention when a Georgia teen was sentenced to 10 years in prison for having consensual oral sex with a 15-year-old girl when he was 17.

In 2005, Genarlow Wilson was tried for the r*pe of a 17-year-old girl at a hotel-room party. While he was found not guilty of that charge, he was convicted of aggravated child molestation for the act with the 15-year-old -- even though he was less than two years older.

Georgia law, which has since been changed, required a mandatory 10-year sentence on the charge of aggravated child molestation and required Wilson to register as a sex offender when he was released. Under the revised Georgia law, the act now would be a misdemeanor.

Now 21, Wilson was released from prison in October -- after serving more than two years -- when the state Supreme Court ruled his sentence was "grossly disproportionate to his crime."

"The current laws leave too much to prosecutorial discretion," Turley said. "We saw in the Wilson case how prosecutorial discretion can lead to grotesque results."

He said statutory r*pe prosecutions of teens are more common in Southern states and small towns than they are elsewhere in the country or in big cities.

B.J. Bernstein, Wilson's attorney, argued throughout his case that Wilson was imprisoned for an act that, while perhaps morally questionable, probably is going on among teens everywhere.

"If you prosecuted, even with misdemeanors, all those cases, you'd clog up the justice system with kids having sex," she said. "It's a social issue -- and it may be something that parents don't want to happen or wish wouldn't happen at that age -- but it shouldn't be a crime."

Spears, who turned 16 on April 4 and says she is 12 weeks into her pregnancy, told the magazine she plans to raise her child in Louisiana, "so it can have a normal family life."

Nickelodeon released a statement saying the network respects Spears' decision "to take responsibility in this sensitive and personal situation."

Because Casey Aldridge is an expectant father — and the mother is 16-year-old Jamie Lynn Spears.
And to hear Aldridge's uncle tell it, the daddy-to-be isn't quite ready to join Spears — the star of "Zoey 101" and the sister of pop star Britney Spears — in the spotlight.
"I don't think they are ready yet to sit down and talk to the media," Odus Jackson, a pastor in Gloster, Miss., told The Associated Press by telephone Thursday. "They haven't gotten their heads together yet."
Jackson said media were already swarming the southern Mississippi town — with a population of 1,073 at last census count — in search of Aldridge, not even 48 hours after the news came that Spears told OK! celebrity magazine about the pregnancy. She said she plans to raise the baby in her home state of Louisiana.
Jackson, 71, said Aldridge left before camera crews ascended Wednesday and was going into hiding. Jackson said he spoke briefly with his nephew, who also lives in Gloster but was often out of town for work.
"He doesn't want to say the wrong thing to the media," Jackson said. "At the right time he will speak."
It's unclear how Aldridge and the younger Spears met or where they spent time together.
Jackson said his nephew briefly attended a junior college in Mississippi but now works for a pipe-laying company in Baton Rouge, La. He attended school at Amite School Center in nearby Liberty, Miss., where he played football and baseball, principal Dan Brewer said.
Brewer, who was not principal when Aldridge graduated last year, said the teen went to school with his daughter and has visited his home. Aldridge was class president, and was honored by his senior classmates as "campus favorite" and "most versatile."
"He was just a super dude," Brewer said.
Jackson said Aldridge enjoys deer hunting and rode dirt bikes. His parents, Joyce and Mark, currently live in Tennessee.
"He is a quiet guy," Jackson said. "That is why it is going to be very difficult to corner him until everybody is ready to talk together on the same page. He doesn't like the limelight. He is going to hide as much as he can."
Jackson denied reports that his nephew and Spears, who was a guest at Jackson's home this past Thanksgiving, were no longer together.
"I think they are going to try to stay together," he said. "They certainly don't want to part."
Jackson said Aldridge has told family members that "he wants to go ahead and get married as soon as possible." Jackson added that the two do not want to "rush into it."
 
Their relationship may be doomed anyway...Jamie Lynn is too young to commit fully. And he is at college age...eh...
 
Is the guy 18 or 19?? There are conflicting reports out there most likely to minize the age difference between the two teens.

I'm sorry, but if he is charged with statutory r*pe, the legal system needs to do some serious re-evaluations... this was obviously consensual, and I highly doubt that a nineteen year old boy is more skilled at the ~mind trickery~ of getting into a sixteen year old's jeans than any sixteen or seventeen year old boy.

People are just too quick to call statutory r*pe... while there are certainly plenty of girls that are victimized by older men who know just how to get to them without them even realizing it, I've also known a few girls that intentionally seduced a teacher or two. If a sixteen year old could be a married parent, member of society, and occasional throne usurper in the ancient world, why are they always assumed to be the victims of people two or three years older than they are now?
 
^I don't think the law cares if it's consensual or not. It's the fact that he's legally an adult and not underage. And I think they might have set the regulations regardless.

IN yet another twist to the Spears family saga, Britney's pregnant teenage sister Jamie Lynn is reported to be marrying the father of her unborn child, Casey Aldridge.
Jamie Lynn Spears, 16, who revealed on Tuesday that she is expecting her first child, is reportedly "desperate" to marry her 17-year-old boyfriend, despite her parents' hesitations.

A source close to the Spears family said: "Jamie Lynn and Casey want to get married really bad. But both sets of parents don't think they should. They think they are too young and should wait.

"The problem with Jamie Lynn is that she is a teenager. She doesn't understand the ramifications. She's just a child with not a lick of sense.

"There's no reasoning with her. Jamie Lynn is not thinking 10 years down the road - not even two years down the road."

And why wouldn't Jamie Lynn get pregnant at 16? Britney's shown that you can have kids and party like an 18 yr old. And when you're a bit sick of the kids and want someone else to have to look after them.........just go a bit crazier, and eventually someone else will take custody of them! I mean, there's just no downside to kids. And by the time they're 6, they can count higher than you and spell better. Someone to do your thinking for you.
 
In the south sometimes you can get married that young with parental consent. Creepy but true...
 
Almost 50 years ago, my uncle (my dad's older brother) got my aunt pregnant. He was 14. She was 13. My grandmother MADE them get married. Unbelievably enough, they are still married! My family is by no means dysfunctional and this was a very isolated incident. Even though I make jokes from time to time about this situation with J-L Spears, it really can happen to anyone.
