Just weeks away from completing her court-ordered stay at the Betty Ford Center, Lindsay Lohan is being investigated by police after allegedly assaulting a female employee at the clinic.
Palm Desert police conducted a battery investigation at the scene at about 1 a.m. on Dec. 12. "The victim desired prosecution," says Sgt. Joe Borja of the Riverside County Sheriff's Department. "The incident is being investigated as a misdemeanor."
A source close to Lohan, 24, says the actress denies pushing the woman first. The staffer scolded Lohan for allegedly returning past curfew after spending the evening at a local bar, TMZ reports.
It isn't known whether she had been drinking; the Betty Ford Center regularly tests patients for
Sgt. Borja explains that no arrest was made because the incident didn't occur in front of an officer.
Lohan, 24, has been at the Rancho Mirage, Calif., facility since Sept. 28, and was ordered by a Beverly Hills judge to remain there until at least Jan. 3.
It remains to be seen whether the incident would be deemed a violation of Lohan's probation terms stemming from her ongoing DUI case. A violation could send her back to jail.
As of Tuesday, Beverly Hills Superior Court Judge Elden Fox, who's overseeing her case, has not been notified, according to a court source.

1) LiLoser has not earned any "right" to get pissy with a staffer, yet -- she's there at the privilege of the court,
2) There's supposed to be staff present 24/7 in all alternate housing. Someone should be fired for that.

This is beginning to look bad for Betty Ford.
They need to make a recommendation to the judge and divorce themselves from LiLoser.
I wonder if some pressure will be put on the staffer to drop the charges, being that it only perpetuates publicizing the BF halfway house relapse party?
I guarantee they right now are answering her certain "I'm a victim" pleas: What, better who, is the common denominator in all of these problems, LL ..... you!
It is hard to believe she is going to be a shining example of success for BF...One of her first trips away from the facility is to go sit in a bar with the old gang?? 
Talk about a bad sign...I know people in recovery who avoid any alcohol related scene like the plague; Lindsay seems to already feel it is OK- even while she is still in treatment! Now she gets physical with a staff member who confronts her about it?? What would this make- five failed rehabs?? It's the bottom of the ninth with two outs, Lindsay- at some point the judge will say lock her up and forget about 'breaks' and treatment...

Lindsay Lohan is a suspect in a criminal battery investigation and the alleged victim -- a staff member at Betty Ford -- wants Lindsay prosecuted ... this according to law enforcement sources.
The Palm Desert Police Department is now investigating an altercation that occurred after Lindsay and her roommates reportedly went to a bar and came back home. Upon arriving at the house, the incident with a female staffer from Betty Ford allegedly went down.
The police received a call at 1:03 AM on December 12 for "hand-to-hand battery."
Cops came to Betty Ford after receiving the call and interviewed both the staffer and Lindsay. We're told the staffer "desired prosecution."
We're told when the police finish the investigation, the case will be forwarded to prosecutors for review.

Lindsay Lohan will file a formal complaint against the woman who triggered a criminal investigation against the famous rehabber ... TMZ has learned.
Sources connected with Lindsay tell us Lindsay is adamant ... the staffer whom she pushed earlier this month was the instigator, berating Lindsay and grabbing her before LiLo pushed her.
As TMZ first reported ... the staffer has told cops she wants Lindsay prosecuted for battery.
Lindsay wants Betty Ford to take action against the staffer ... stat.

One person likely to be studying the report is Los Angeles Superior Court Judge Elden S. Fox. He had previously threatened to send Lohan back to jail for up to six months if she screwed up while on probation.
As of now, Lohan is due to get out of rehab on Jan. 3 and due in court for a previously scheduled progress review on Feb. 25.

TMZ has obtained a copy of the incident report Lindsay Lohan's alleged victim sent to officials at the Betty Ford Clinic ... and the allegations of violence are even more serious than first reported.
Dawn Holland -- whom TMZ interviewed Tuesday afternoon -- wrote her report 6 hours after her showdown with Lindsay at Betty Ford. Holland says during the heat of the argument, Lindsay "threw the phone ... I threw up my left hand to block it and then she grabbed my right hand and tried to snatch the phone that I had up to my ear, then called me a 'C__T B___H.'"
As TMZ first reported, Holland was called in by BF security to do a breathalyzer test on Lindsay and her two roommates after they returned from a night of partying past curfew.
According to the incident report, it was Dina Lohan who told Lindsay over the phone no one had to submit to a breathalyzer test. Holland writes one of the roommates admitted drinking, and then went into Lindsay's bedroom and Lindsay "yelled at me that she was talking to her mother and her mother told her she didn't have to breathalize, she asked me if I wanted to speak to her mother but would never hand me the phone."
In the report Holland says she told Lindsay -- whose code name at the clinic is Bella G. -- "You know that I could press charges against you for putting your hands on me. And she replied 'Oh, you want money.'"

The Betty Ford staffer who claims Lindsay Lohan assaulted her tells TMZ ... Lindsay had been drinking before the incident and hurt her so badly, she's now on workers' comp.
Dawn Holland, who works as a chemical technician at the Betty Ford Clinic, tells us on Sunday, December 12, just after 1 AM, Lindsay and two roommates came home from a night on the town ... violating the curfew policy.
Holland says Lindsay and company jumped a wall, trying to get inside the place she was staying without being noticed. Holland says security stopped the three women, and that's when Lindsay became belligerent and started swearing up a storm.
Holland says she was called to do a breathalyzer on the 3 women, but Lindsay refused and then pushed her. Holland says she went back in the house and Lindsay called 911 on the house phone.
Holland says she picked up another house phone to speak with 911, and Lindsay confronted her again and ripped the phone out of her hand, causing a severe sprain which caused Holland to go out on workers' comp.
Holland says she could smell alcohol on Lindsay's breath.
As for Lindsay's claim Holland touched her first, she says, "I did not touch the woman."
As TMZ first reported, Holland filed a police report and the cops are investigating Lindsay for criminal battery.

Most people who work at that type of facility are in recovery, too.
Seeing Holland's photo, and reading the details on TMZ, I totally believe LiLoser went off on her.
Think about it: If she didn't do anything wrong, why run to the phone and call mommy crying??? If you're innocent, you take the test. If you're an adult, you deal with the consequences yourself. The rules still don't apply to LiLoser.
BF should have booted LiLoser for being past curfew and trying to go over a fence to sneak back in. I don't know what they're thinking.

Everything she said is consistent with Lindsay's previous (court documented) behaviour. Nothing was over the top ("she ran over my foot" etc).
Is Lindsay/Dina disputing the fact she arrived back at 1am? The other girls admitted drinking. At the very least Lindsay was out until 1am with people who were drinking.

^ Good point- innocent people don't get hostile about showing they are innocent... I guess BF is letting the police and their lawyers do their thing for a day or two, especially since it looks very much like jail for Lindsay Dee at this point...

First, the Lohan Haters plant paid off security guards and lab technicians in BF, not they have obviously hacked into the FBIs computer records to delete the charges and brainwashed all of the agents nationwide to cover up the stalker!!! My only question is about the bar...The bartenders and waitresses I know would have their cellphone cameras out and be on the phone to The National Enquirer ten seconds after Lindsay walked out of the bar!!

^ And, of course, you would pass the test the next morning as long as you didn't have a great deal to drink....Way to go Linds- beating the system again!!
Any sort of common sense would say that if you were innocent and could go back to jail for months, you would take the breath test right away so there would be no question about it...not that Lindsay and common sense have ever gone together very well...
I think the bigger issue here is how much her treatment has changed her, if after many exposures to the recovery principles, she is sneaking out to a bar at first opportunity...the prospects are extremely dim from what I can see...

^ Yes, and wasn't Promises in Malibu, where she has been a couple of times, supposed to be one of the best too? She has had every opportunity- some 'people with her problems' get busted and sit in jail for a long time waiting for an opening at a treatment center- people who want help! She has had the best sort of treatment, and you can see how much she has taken advantage of the opportunities...
