She will file on the grounds of “Irreconcilable Differences”. The other choice would have required them to go to court, and would have just reflected poorly on both of them. Her attorneys - especially one who worked with her predecessor - have been able to work around most of the restrictions in her original pre-nuptial agreement. She did not fulfill the terms of the contract that would maximize her payout, but she will receive a sizeable chunk of change to keep quiet about his personal life and his special [FONT=Arial, Helvetica, sans-serif, Verdana][FONT=Arial, Helvetica, sans-serif, Verdana]relationship[/FONT][/FONT] with another high-profile man.
She had him served with documents for a “Dissolution of Contract,” not “Dissolution of Marriage”. There is no court filing yet - that’s the next step. She will be asking for sole custody of the kid/s. She is not currently pregnant.

If it is indeed Katie Holmes, then the **** will hit the fan. It'll be bigger than even Brad&Jen's breakup story; imagine all the conspiracy theories and the "homosexual" and Scientology allegations.

It'll be THE biggest breakup story ever, b/c not only is it juicy, there is SO much dirt to dig and create.

Someone on another site said he had a contract with Nicole for ten years but I don't buy it...I think Nicole was genuinely surprised to have the rug pulled out and would still be with him to this day if he didn't serve her.

I believe the fishy story surrounding Tom & Katie though, I think this was about a big payday and non-stop fame for her. Although her career was certainly better before hooking up with him, maybe she really wanted financial security. And we all know what he got in return...

If this is true, GOOD for Katie! I mean, the woman is so haggard and distressed from the marriage that she has managed to look twice her age. She needs to get that money, dress like she is 30 and not 50, start dating a hot actor her age, write a tell-all book, and bag some major contracts.

The two are not mutually exclusive.

My guess is at some point she just wanted to go back to having normal life, a normal relashionship and have real kids and make a real family, not the hollywood thing.

thing is, she's not exposing herself or her relationship and her family as much as she used to when she was with tom.
