This sort of thing is why expensive lawyers and their people are worth the money- reasonable doubt and all that...Of course, it does help if you pay them once in a while, in between breaking in expensive sports cars and shopping sprees! :rolleyes:

Lindsay Lohan: Bad Jewelry = Good Defense to Felony

Lindsay Lohan's bad taste in jewelry could be the key to her defense, because according to TMZ's research, the necklace in question may not have enough value to constitute felony grand theft.

In order to charge a defendant with a felony, the item in question must have a fair market value of more than $950.

Kamofie & Company was selling the necklace for $2,500. But we checked with three prominent jewelers in L.A., and they claim the price tag is grossly inflated.

The jewelers asked us not to identify their stores by name, but here's their assessment of the item. We gave them information from the necklace designer, who told TMZ it was comprised of 8.84 carats of natural, untreated yellow diamonds.

-- A Santa Monica jeweler told us the necklace is "a dime a dozen," and he wouldn't think of selling it for more than $1,000.

-- A downtown L.A. jeweler says if the item is retailing for $2,500, it means "the stone is cheap," adding, "It's most likely an industrial-type diamond, not gem quality." He says the necklace is worth no more than $900.

-- A San Fernando Valley jeweler says, "I don't believe this necklace has 8 carats of diamonds. It's so thin." She says the chain would sell in the jewelry district of downtown L.A. for $800 tops -- and probably less.

Under California law, if the necklace is worth $950 or less, Lindsay could only be charged with petty theft, a misdemeanor. The maximum penalty is 6 months in L.A. County Jail -- and with jail overcrowding she's looking at a short stint.

If Lindsay's lawyer, Shawn Chapman Holley can convince the judge that the necklace is cheap, Lindsay could dodge the biggest bullet yet.

That's funny, this necklace case is tiny compared to her upcoming civil trial. Does Lindsay own a house? I'm very interested to know how she will pay the compensation her three carjacking victims will win (is the woman she chased part of this too?).

The judge sounded very angry and I believe he will sentence her. Lindsay escaped Judge Revel and Judge Fox - can she really fool a third one?

And Memo to Lilo: Court ordered judgements are not discharged in bankruptcy proceedings, so you, Dearest Lindsay Dee, will be on the hook for the rest of your life for this money...Imagine getting herself straightened out and having to do crap movies just to pay off these law suits...for years to come...Welcome to the real world, baby!! :shock:
 
Yea I bet she could star in a lot of low budget movies if she wanted to. At this point she should only be concerned with proving she can turn up to a movie set for at least a month...no, a week... and work full days. The problem is that she isn't interested in acting, only in getting attention. If she did care about her acting 'career' she would do things like go to school and study drama, take part in some small theatre productions etc.

But her respectable words (except for the fact that the demonstrations weren't entirely "peaceful," but, you know, baby steps) were preceded by all sorts of juicy news...

WE'RE RUNNING OUT OF CAPTIONS FOR LINDSAY: The onetime Parent Trap cutie pleaded not guilty to felony grand theft after being accused of lifting a $2,500 necklace from a Venice jewelry store. Lindsay vowed via Twitter that she sometimes parties with Kanye West and would "never steal," and we're inclined to believe it was an accident, that she just walked out of there all entitled-like, either forgetting it was on or assuming it was a loaner and not meaning to put one over on anybody. But not to worry, nobody gets locked up anymore unless they're violating probation... Oh, wait... On the bright side, Lindsay's hair looked great and designer Kimberly Ovitz has already sold out of the dress that she wore, questionably, to her arraignment.

Shawn Holley (no longer Shawn Chapman Holley) tells TMZ, "We intend to challenge the prosecution's case because the truth is, Ms. Lohan didn't steal anything. But even if she had, it seems to me that the appropriate charge, based on the fair market value of the goods, should have been petty theft and not grand theft."

TMZ broke the story ... various Los Angeles jewelers believe the necklace LIndsay allegedly stole isn't worth nearly the $2,500 Komofie & Co. was asking. Under California law, the item in question must have a "fair market value" of more than $950 to constitute grand theft. The jewelers we spoke with said the fair market value ranged between $800 and $1,000. If the value is $950 or less, it would be petty theft, a misdemeanor punishable by six months in jail, rather than one year in prison.

There have been countless cases in which people charged with grand theft successfully defended themselves by asserting that prosecutors overinflated the fair market value of the item that was allegedly stolen.

As Holley put it, "A $5 lump of coal with a $2,500 price tag is still a $5 lump of coal."

Lindsay Lohan wants to open her own boutique -- selling something she knows a little about -- jewelry and fashion!

The Mean Girls star, 24, is making plans to open two stores, one in Venice, California, and Soho, New York, in partnership with mother Dina, RadarOnline.com has exclusively learned.

"Both Dina and Lindsay love the fashion industry and are excited to do this together," a close family friend told Radaronline.com.

The mother-daughter fashionistas have plans to sell both clothing and jewelry, we're told, while the rehabbed starlet splits her time between both coasts.

"Right now, Lindsay loves being in Venice in her new home and enjoys the walk into town," said the source.

As RadarOnline.com reported, Lohan entered a plea of not guilty to a felony grand theft charge at the Airport Courthouse in Los Angeles on Wednesday, before Superior Court Judge Keith L. Schwartz.

He warned the starlet not to "push your luck" between now and her next courtroom appearance.

Lohan allegedly stole a $2,500 "one of a kind" necklace from a jewelry store in Venice Beach, California, as we first revealed.

While her mom was not in court, the pair have been in constant contact according to the pal, discussing their grand plan.

"Lindsay and her mom will be looking for a place in downtown Manhatten as soon as her ban to travel has been lifted," said our source.

"For now she's awaiting her February 25 probation hearing and preparing for a visit from her mom and siblings."

^ She moved out to escape the police. I think she's hiding in a hotel right now until the next hearing and closely monitoring the situation in Egypt, so no new photo ops. If you see any candids of Hilary Clinton going into a hotel in the LA area, that's where Lindsay will be.

but at least if she opens her own boutique, when she walks out the door with a necklace on they cant say she stole it :lol:
