Lindsay Lohan can breathe easy...for now.
E! News has confirmed the Los Angeles County District Attorney's Office will not be charging the troubled starlet today with felony theft for allegedly swiping a $2,500 necklace—which means mom Dina Lohan, can go back to fuming over Glee dissing her on its post-Super Bowl broadcast.
So where's the Lindsay case stand?
"Absolutely nothing will be filed today," D.A. spokeswoman Jane Robison tells E! News.
Right now, longtime Lohan nemesis Danette Meyers (who prosecuted the actress's DUI case) is still going over the evidence presented last week by the LAPD.
If Meyers agrees with police that a felony charge is warranted then a criminal complaint will be filed. But because Lohan would be considered a nonviolent offender, the D.A. would not dispatch police to take her into custody. Instead, Team Loan would would either negotiate a surrender or prosecutor's would just set an arraignment date for her to appear.
Over the weekend, Lohan attorney Shawn Chapman Holley issued a statement saying, "We vehemently deny these allegations, and If charges are filed, we will fight them in court, not in the press."
Meanwhile, sources close to the Lohan family seem to be in denial about the seriousness of the alleged felony, which carries a maximum three-year state prison sentence.
"No one [in the family] really thinks she's going to get charged," said the family insider. "They believe she didn't steal the necklace. They think it's a non-case."
After all, mom Dina has more importaint things to fixate on, like getting dissed on Glee when on last night's episode Katie Couric branded Jane Lynch's Sue Sylvester the "Loser of the Year," besting Dina for the honor.

Lindsay Lohan and "Glee" kissed and made up after the cast apologized for the LiLo joke they made last year -- but after the show badmouthed her mother last night, they're back to being enemies.


In the big Super Bowl episode last night, Dina Lohan was included on a fictional list of "losers of the year" -- this after the show called Lindsay "crazy" in an episode last November.

Sources close to Lindsay tell TMZ she feels the show should "mind its own business" and "stop picking on their family."

Sources close to LiLo tell TMZ ... Lindsay's people have had multiple phone conversations within the last few weeks with the people behind the new "Superman" reboot. We're told Lindsay is up for a role in the flick -- and while it isn't Lois Lane, we hear it would be a "major character."

We're told Lindsay is supposed to meet personally with the "Superman" people soon -- but she might be a little busy with that felony grand theft charge thing.

According to our sources, Lindsay is "dying to show people again how talented she is" and is worried this latest run-in with the law (for which she maintains she's innocent) could ruin her shot at the movie.

Apparently that necklace she's accused of stealing is made out of kryptonite.

Reps for Warner Bros had no comment.

^ I swear, Lindsay's "people" (no doubt her mother) put this stuff out there just to create buzz that she is still so sought after; it seems like every time one of these things hits the internet it is followed by a denial from the other party...The only (crazy) possibility would be something like a quick one or two day shoot for a minor role just to create interest in a floundering project; who would sign someone completely unreliable who may very well be back in jail soon for a "major role"? And who would insure their participation? Jeeze- they have trouble getting financing for dependable, bankable "stars" projects these days!! :blink:

Dina thinks that because Lindsay starred in some hit movies 10 years ago it means she's an A list star forever. In Hollywood it matters what an actor did last year and is doing next year. The only way around that is to become an established celebrity and maintain your looks so it doesn't matter if you don't have a hit movie for 10 years (i.e. Sharon Stone).

TMZ has learned ... Lindsay Lohan will be charged with felony grand theft tomorrow.

Sources connected with the case tell us ... the single count of felony grand theft will be filed at Airport Court in L.A. Wednesday morning.

Lindsay will be arraigned at 1:30 PM. She must be present for the hearing.

Lindsay will be charged with stealing a $2,500 necklace from an L.A. jewelry store.

If convicted, she could be sent to California State prison.

Actually, he seems to be asleep and totally unaware that some deplorable human being is snapping photos of him to sell to TMZ. I don't like the guy, based on what I've read, **Please respect other members, see our community rules**

I really hope she suffers real consequences this time and does not get away with breaking the law, because she's a "celebrity". I'm beyond tired of the special treatment. This girl clearly needs a smack of reality. NO MORE kid gloves.
 
i know its different circumstances, but look at the celebs who went to jail/prison and didnt get out early..
they were still celebs and they didnt get treated any differently..
so why should lindsay ?

Lindsay Lohan is telling friends ... she's pleading not guilty tomorrow with vigor, because she says, "I honestly feel I did nothing wrong."

Lohan is saying privately, "I'm pleading not guilty because I'm NOT!"

TMZ broke the story ... Lindsay will be charged Wednesday with felony grand theft for allegedly stealing a $2,500 necklace.

She'll be arraigned at 1:30 PM PT... and TMZ will livestream the hearing.

No Perp Walk For Lindsay Lohan

Lindsay Lohan will not be handcuffed and paraded in front of cameras Wednesday before her arraignment on felony grand theft charges ... sources connected with the case tell TMZ.
Our sources say there will be no "perp walk" -- which is when someone charged with a crime is arrested, cuffed and taken to the cop shop for all to see.

Instead, Lindsay, seen above leaving her probation officer this morning, will simply surrender to the court when she shows up for her arraignment tomorrow.

After Lindsay is arraigned, she will be taken to the basement of the courthouse where her booking photo will be taken ... then released after bail is posted.

EXCLUSIVE: D.A. Seeking Six Months Jail For Lindsay Lohan For Probation Violation
The Los Angeles District Attorney's office will seek a six month jail sentence for Lindsay Lohan for probation violation, RadarOnline.com has exclusively learned.

This is in addition to any sentence recommended if the 24-year-old is found guilty on the felony grand theft charge she will be arraigned on tomorrow.

The source tells RadarOnline.com: "The DA is going to be asking Judge Schwartz to put Lindsay in jail for violating terms of her probation for six months in county. This is a separate matter from her new felony case."

As RadarOnline.com previously reported Lohan will be formally arraigned Wednesday afternoon at the Airport Courthouse in Los Angeles County, on one charge of felony grand theft.

Other sources connected to the case tell RadarOnline.com: "Lindsay's probation will be revoked by Judge Keith Schwartz immediately. She will be formally arraigned on the single charge, and at that time she will be expected to enter a plea of either not guilty or guilty.

“Lindsay will be remanded into custody, again, and her bail bondsman will be there to get her out. It's anticipated that her bail will be around $75,000-100,000."

The sources say that once Judge Schwartz handles the arraignment, he will then deal with her probation violation, scheduling a hearing for a later date - Lohan is still on probation from her 2007 DUI convictions.

Judge Schwartz will be overseeing this, and not Judge Fox, who oversaw her past court travails last year which led to a court-ordered stay at the Betty Ford Center.

And in what is bound to be bad news to Lindsay, Schwartz could order the troubled actress to once again don the dreaded ankle bracelet which detects if she has been drinking.

Lindsay Had Enough Cash For Jewelry Purchase

Lindsay Lohan had more than enough cash on hand when she took the $2,500 necklace out of an L.A. jewelry store ... sources tell TMZ.

TMZ broke the story ... the L.A. County District Attorney's Office will file felony grand theft charges against Lohan any day ... though we're told it won't be today.

Sources connected to the case tell us ... Lindsay had around $6,000 in cash with her because she had been eyeing a ring in the store, which was going for $3,400. Lindsay had gone to the store several times previously, debating whether to buy it.

Short story ... Lindsay had enough money to buy both the ring and the necklace on the day in question.

We've learned the surveillance video shows Lindsay walking out of the store wearing the necklace, without paying. In the video, the necklace is partially hidden by other jewelry Lindsay is wearing around her neck.

D.A. Focuses On Lindsay's Shady Shopping


The L.A. County District Attorney believes Lindsay Lohan is a seasoned fashion thief, and that's a primary reason why she's being prosecuted for felony grand theft.

Sources connected to the case tell us ... in deciding whether to prosecute, the D.A.'s Office heavily considered 3 incidents where Lindsay allegedly pilfered expensive items:

-- She was suspected of taking a $400,000 necklace in 2009 from an Elle Magazine photo shoot.

-- She was accused of stealing a $12,000 mink coat in 2008 from a NYC nightclub.

-- She was accused of taking a $35,000 Rolex from a "friend" in 2010.

Lindsay was not prosecuted or convicted in the three cases, but sources say prosecutors not only heavily considered the prior incidents in making their decision ... they will ask the judge to admit the 3 incidents into evidence to show "prior bad acts" if the case goes to trial.

Our sources say there are two other factors that weighed heavily in the decision to prosecute:

-- Lindsay has had repeated run-ins with the law, including 2 DUIs.

-- She repeatedly thumbed her nose at the legal system by failing to perform her probation requirements, blowing off court appearances (remember that trip to Cannes?) and acting disrespectfully before the judge (the whole fingernail thing).

As TMZ reported, the D.A. has a surveillance video which shows Lindsay walking out of a Venice, CA jewelry store with the $2,500 necklace in question. The necklace is partially hidden by other trinkets around Lindsay's neck.

Lindsay will be arraigned today at 1:30 PM PT. Lindsay will be in court, accompanied by her lawyer, Shawn Chapman Holley. Prosecutor Danette Meyers reps the people of the State of California.

TMZ will livestream the hearing.

Lindsay Lohan Accused of Burning Tanning Company

Lindsay Lohan is being sued by a mobile tanning company that claims they bronzed the actress up from 2007 to 2009 ... but she stiffed them on the $40k bill.

Lorit Simon claims Lohan hired her Nevada-based company, Tanning Vegas -- and the job required interstate travel when Lohan was craving a color change.

In the lawsuit filed last week in Nevada, Simon claims Lohan racked up $41,031.60 in unpaid charges -- and even now, she refuses to settle her debt.

Simon wants Lohan to fork over the money -- plus attorney's fees and interest.

Simon has sued Lindsay before -- accusing the actress of stealing her secret formula for a spray tanning product and selling it under her own Sevin Nyne label.
