^ Yes- Ice down the Dom, we really made a fool out of that judge, didn't we!! B)

Here's the run down...Only a fool would go to trail in this situation...

TMZ broke the story this morning ... the judge will throw Lindsay in jail if she accepts a plea bargain.

Judge Keith Schwartz told the famous defendant bluntly, "I don't care that you're Lindsay Lohan."

Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea.

And, Judge Schwartz wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate.

The judge explained ... if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation.

And the judge announced what TMZ first reported ... Deputy D.A. Danette Meyers made a formal offer to settle the case. Lindsay's lawyer, Shawn Holley, will noodle over the offer before deciding, but the judge indicated Lindsay's probably not going to accept the D.A.'s offer. As we reported, Meyers wants significant jail time.

If Lindsay doesn't accept a plea, she'll stand trial and if she's found guilty she could get 1 year in state prison.

Lindsay is back in court on March 10. She has the option of pleading guilty and basically throwing herself at the court's mercy.

Now Michael is holding a press conference talking about the divorce, saying that he "doesn't see her as a criminal"

^ Right- just a fun loving girl out with her friends listening to music...we know...

Sources connected with the Lindsay Lohan case tell TMZ ... the offer Deputy D.A. Danette Meyers made to Lindsay's lawyer in chambers was SIX MONTHS in jail.

Judge Keith Schwartz said in open court he had a feeling Shawn Holley would pass on the D.A.'s offer. That's because Lindsay will not accept jail time -- at least not now.

But here's why we're almost positive Lindsay will eventually cop a plea. She is going to jail no matter what.

The judge ruled Lindsay's preliminary hearing and probation violation case will be heard at the same time. At the end of the preliminary hearing, if the judge feels it's more likely than not that she stole the necklace, Lindsay will be thrown in jail immediately while she awaits trial on the grand theft case.

So even if Lindsay is ultimately found not guilty at trial, she'll still be in jail for the probation violation.

Short story ... it's likely Holley will plead guilty or no contest on behalf of her client, and then hope the judge gives Lindsay less than 6 months.

i wonder how quickly lindsay would stand trial for theft. can anyone hazard a guess? would they set the date on march 10?

I don't see a way out for her, at this point.

That's the problem with doing crime while on probation -- rules are different.

Oh, by the way ..... judge should add 3 months to her sentence for those pants. :yuk:

^ Yeah- the video of her 'bouncing' out of the building, I would say 4 months extra...real respectful...

she treats the walk in and out of the court as if shes a supermodel strutting on a runway...

^^ You got the 'strutting' part right. More like Hollywood Blvd though.

But with bad posture.

At least she's wearing the "correct" black & white jailbird colors.

Brittny Gastineau came to Lindsay Lohan’s rescue on Tuesday, when the court-bound starlet didn’t know what to wear for her Wednesday meeting with Judge Keith Schwartz, loaning her about $5,000 worth of bling.

RadarOnline.com spoke to the reality show star and Tres Glam jewelry designer, where she dished on Lindsay’s troubles -- including her courtroom wardrobe dilemma.

“We have been friends for a long time and I feel really sad for her,” Brittny told Radar.

“Everyone has their opinion about what happened, but I just feel bad for her. She has just had such a hard time, and hopefully this will be the last of it.”

Lindsay and Brittny spoke on the phone on Tuesday night about the impending court hearing, and Lindsay revealed that needed some help with her court fashion.

“I spoke to Lindsay last night and she was concerned about the trial and wondered what she should wear,” Brittny revealed to Radar.

Brittny loaned her longtime pal an “anti envy diamond protection eye necklace,” worth $3,000 and Heart Locket earrings, which sell for $1,800, to bling out her Chanel, Lanvin and Yves Saint Laurent ensemble.

“I thought my Diamond Protection Eye Anti Envy necklace would be a good idea under the circumstances,” explained Brittny.

her Chanel, Lanvin and Yves Saint Laurent ensemble.

I think Old Navy would be better for court if she's interested in showing humility.

Court again tomorrow (Friday 25th)

I say she goes for JPG couture!

^ Court again?? What for??

(BTW- The Long Island Girls stick together, huh? Can we hope for the Kardashians becoming as relevant and out of sight as Brittny Gastineau and her mother in days to come?? I thought by now they both would be married to guys from the NY Jets or some local mob guys...

^ oops, I found out that the 25th court date has been cancelled. So the next date is in 2 weeks.
The actress is on supervised probation for a drunken driving conviction. The judge overseeing that case told her in October that he would send her to jail for 180 days if she violated her probation rules before her next court appearance, set for February 25. That court date is now off, with Schwartz taking over Lohan's legal cases.

^ Damn- this court is no fun at all!! First they don't make fun of her boobs hanging out, don't slap the cuffs on her for a "Mommy, help me" moment, and now they cancel another court appearance...seems like you just can't count on the Government to do the right thing... :(

Anyone know what happened to our old friend SCRAM? She was ticketed for going 59 mph in a 30 mph zone - while on probation and with 3 DUIs to her name; how does she still have a license? Is there nothing like a points system in California for driving?
