^ That's true- it would be the equivalent of water boarding to deny those inalienable human rights to an innocent young lady like Lindsay who, after all, just loves to work all the time and go out and have fun with her friends, listening to music...:huh:
BTW- with all of Michael and Dina's never ending legal situations, I always imagine their personal lawyer is a guy named Manny who has an office above a tanning salon in the SuperFresh Shopping Center on the Sunrise Highway in Merrick... :unsure:

  • Lindsay’s father, Michael, who was sitting in the front row sandwiched between the owners of Inspirations for Youth and Families, a teen rehab clinic where he works as a consultant, told The Daily Beast that Lohan should not take a deal.
  • “[Store staff] gave her a necklace to wear and promote and when it showed up in the paper after three days and the store wasn’t mentioned they got pissed off and reported it stolen,” he said.
  • Lohan, who said his daughter was at the store with two other friends who plan to testify on her behalf if the case goes to court, claimed that the police report of the incident gave three different accounts of what happened. He also claimed that he had a witness who saw the same “one of a kind” necklace on sale at the same store for $800, which would make the charge a misdemeanor petty theft and not a felony. “It was a misunderstanding,” he said. “I think the value of the necklace was trumped up. The whole situation is trumped up. She has worked hard on her recovery. It saddens me…The truth is going to come out and she will be vindicated.”
 
^ That's almost like an automatic acquittal- if someone accused of a felony has a friend who saw something and says so...it's surprising the DA would even pursue such a case... :rolleyes:
 
radaronline talks with a source that has viewed the videos...

[FONT=Verdana,Helvetica,Arial]A male shopping with Lindsay Lohan at the beachside jewelry store in Venice, California, distracted an employee as the Mean Girls star stole a gold designer necklace -- this according to a law enforcement source who has intimate knowledge of the surveillance video.[/FONT]
"Lindsay had removed a necklace of hers that she was wearing when she tried on the necklace in question," the source close to the case told RadarOnline.com, exclusively.


"As Lindsay was putting her necklace back on, it's apparent the store clerk was distracted by the male companion that was with Lindsay."
The sales associate provided a statement to investigators claiming she didn't realize that Lohan hadn't taken the necklace off, RadarOnline.com has learned.


"The video then shows Lindsay and her male friend walking out of the store, all while Lindsay was wearing the necklace," said the source.
"It's all clearly visible on the video."


Lohan, 24, pleaded not guilty on February 8 to a single count of felony grand theft; if convicted, she could be sent to prison for up to three years.
Worryingly for the starlet, prosecutors believe the store surveillance video is strong evidence against her and one source even described it as a "smoking gun".


"The District Attorney believes that Lindsay's friend distracted the clerk on purpose and that could bolster the case if it goes to trial against Lindsay," said the source.
"This simply wasn't a case of miscommunication of a necklace being loaned and not returned, as Lindsay has claimed."


"Distraction theft" -- as it is known in some legal quarters -- if proved, can help establish a criminal's intent.
Lohan's high-powered lawyer Shawn Holley didn't receive the video until Wednesday at L.A.'s Airport Courthouse, where the actress appeared before Superior Court Judge Keith Schwartz for a routine hearing.


"This case does involve jail time -- period," Schwartz told Lohan, warning actress that he would send her to jail if she accepted a plea deal offered by prosecutors.
"If you plead in front of me -- if this case resolves in front of me -- you are going to jail. Period. It may be an issue as to amount of time."


Schwartz said that if Lohan rejects the offer the case will be set for a preliminary hearing in front of another judge; she must decide by her next court date on Thursday, March 10.
 
If Shawn Holley herself hasn't developed a drinking problem by this point it is a miracle....! :(

Lindsay Lohan just showed up at the law office of one of the most powerful lawyers in L.A. -- Blair Berk ... to noodle over her felony grand theft case ... TMZ has learned.

Sources tell us Shawn Holley and Lindsay decided to call Berk and ask her to review the evidence in the case and strategize with Lindsay.

Holley is and will continue to be Lindsay's lawyer, but in this kind of a pickle, two heads are better than one.

Berk, by the way, is the lawyer who repped Lindsay when she got her 2 DUI's ... and managed to get her off with a legal slap on the wrist.

It's likely Berk and Lindsay will discuss the D.A.'s plea offer, which would require her to accept 6 months in jail.

If Charlie Sheen doesn't "straighten up," he will NOT star in the upcoming "Major League" movie ... because the man in charge of the flick tells us he doesn't want another Lindsay Lohan situation.

TMZ spoke with James G. Robinson -- CEO of Morgan Creek Productions -- who tells us, "I'm not going to risk putting Charlie in the movie if he continues messing up."

Robinson continues, "Obviously with Major League 3 there's a huge part written for Charlie's character ... but after dealing with Lindsay Lohan on 'Georgia Rule,' I can speak for someone who has experienced the difficulties of working with an actor dealing with ***please see tFS community rules***."...

Robinson explains, "When Lindsay was doing 'Georgia Rule,' she would miss full days of work. When an actor doesn't show up for work, you can lose half-a-million dollars a day paying the 250 other people there for the shoot and the costs for the set."

^ This guy should talk to the producers of Lindsay's next movie- he said he had no trouble getting insurance for the shoot- everyone wants to put millions at risk to cover a Sheen or a Lohan film!! :blink:

EXCLUSIVE INTERVIEW: Lindsay Lohan Feels 'Beaten Up', Says Director Hoping To Launch Her Comeback

When a judge warned Lindsay Lohan that she is likely facing jail, the troubled star remained calm and collected, but RadarOnline.com has exclusively learned that in reality she feels, "beaten up" and "unhappy" about possible prison time.

In an exclusive interview, director Nathan Folks -- the man hoping to launch her comeback -- says Lohan feels like the victim of a vicious publicity stunt after being accused of stealing a $2,500 necklace, and is determined to come back fighting.

"She feels beaten up," he told RadarOnline.com. "I spoke with her after court and she was not happy with what happened. She just wanted to get on with her life and Lindsay can't do that until this is all over.

"What this jewelry store has done for publicity, has really got to her."

Folks -- who calls Lohan a good friend -- has cast the actress in her first post-rehab movie, Escaping The Game, and says she is determined to see it through to prove to people she's turned her life around.

"She is clean," he said. "She really wants this to be her comeback, and I want it to be for her. I'm convinced it will be and I will do everything in my power to make it happen.

"We don't know if she is going to jail, so for now the show must go on. In fact she is going to start training this weekend for all the action this movie is going to offer."

And if all goes well, Folks thinks the world has another Angelina Jolie on its hands.

"Her character is a strong woman. She will play an ex CIA agent, so she has to be tough. There will be lots of action and stunts, and she has to be prepared.

"She will play a role like Angelina Jolie's character in Salt. And lets face it even Angelina went through a rough time in the beginning. She had a very dark time but got these type of roles and managed to turn her life around.

"I believe this is what will happen to Lindsay, and she could be the next Angelina. If Lindsay heard people saying that about her, she would be over the moon. People need to believe in her.

"If she wasn't able to film because she was in jail, of course I would have to recast her. But I'm fighting for her all the way."

Folks is planning to start shooting in August and hopes the film will be released in March 2012.

Lindsay's next court appearance is Thursday, March 10 on her felony grand theft case.

I would describe it as delusional... Folks should hope Angelina's lawyers don't describe it as libelous. :lol:

...he told Radar Online yesterday—that he's in talks with HBO about headlining his own show called Sheen's Corner at $5 million per episode (think this is news to HBO execs?)
