Lindsay: Early Release IS Available -- 14 Days Likely

TMZ has learned ... The L.A. County Sheriff's Department now says Lindsay Lohan is eligible for early release, even with home detention instead of jail -- which means she will probably end up locked up at home for only around 2 weeks.

TMZ posted a story yesterday ... quoting an L.A. County Sheriff's official ... stating that she may not get early release based on jail overcrowding, and therefore she would likely serve roughly 84 days of the 120 day sentence.

But now we're told ... the Sheriff's position is that Lindsay CAN get early release ... short story -- around 14 days will do it.

So Wednesday, after Lindsay pleads no contest to misdemeanor theft, it's likely Lindsay will end up with electronic monitoring at home, and she's at the beach for cryin' out loud.

2 week stay in a luxury house for committing theft while on probation, that sounds like a good deterrent for other diamond thieves.

Lindsay Lohan has been sentenced Wednesday after pleading no contest in the theft of a necklace. She also surprisingly abandoned her appeal in her DUI probation location case.

In a case that has riveted Hollywood, Lindsay was accused of stealing a necklace originally valued at $2500 from a Venice Beach, Ca. jewelry store last January.
Lindsay was not in court Wednesday morning. Her attorney Shawn Holley was there representing her.
She was sentenced to three year’s probation, ordered to stay away from the jeweler, Kamofie & Co., attend The Shoplifter’s Alternative program, have psychological counseling, and pay fines totaling $180.

Surveillance video tape of the event was later sold and aired on TV and the Internet, and a judge later knocked the charge down to a misdemeanor.
Through it all, Lindsay – through her attorney Shawn Holley – insisted she hadn’t done anything wrong.

This is a separate issue than the sentence Lohan received for violating the terms of her DUI probation. Last month the judge found that she’d violated her probation and sentenced her to 480 hours of community service and 120 days in jail. That sentence was restated at today’s hearing.
The judge ordered Lindsay to turn herself in to the jail for her 120 days on June 17. She’s already applied to have that sentence changed to house arrest, and is likely to be approved for it.

Lohan has already begun the community service even while appealing the jail term. The judge ordered that her community service and her house arrest must be served consecutively. (radaronline)

Lohan just released a statement saying, "I am glad to be able to put this past me and move on with my life and my career. I support the judge's decision and hold myself accountable for being in this situation."

Lohan added, "I have already started my community service at the Downtown Women's Center and thank everyone there for their warm welcome.

She concluded, "I hope to be able to fulfill my obligation without any press attention. I think the media spotlight should be on issues such as homelessness and domestic violence instead of on me."

Lindsay Lohan Tested Positive for Alcohol After Rehab

Lindsay Lohan drank alcohol the night she scuffled with a Betty Ford employee and failed a random alcohol test after she left rehab, according to a probation report.

The report, released Wednesday after her no-contest plea to misdemeanor theft of a $2,500 necklace, also states that Lohan "has been suspected of similar conduct in other jewelry stores," but no charges were ever filed.

The probation report says Lohan indeed drank alcohol after sneaking out from the Betty Ford Center in December, citing local police interviews with restaurant and nightclub employees. Charges that she battered a rehab employee that night were dropped for lack of evidence.

And Lohan, 24, tested positive for alcohol in February, one week after her assistant surrendered the allegedly stolen necklace to the LAPD.

"The probation officer believes that substance abuse is the root of the defendant's problems," the report says, although L.A. Superior Court Judge Stephanie Sautner disagreed with that assessment on Wednesday.

Instead, Lohan was ordered to psychological counseling instead of more rehab, in addition to a four-month jail term and community service. For now, Lohan will not be randomly tested for drug and alcohol use.

She is expected to be allowed to serve her jail term in home detention because she's a nonviolent offender and is eligible for early release for good behavior as well as budget constraints.

With all of Lindsay Lohan's legal troubles she has run up a hefty bill but her dad Michael tells RadarOnline.com exclusively that he's going to take care of it.

"I am committed to paying Lindsay’s $135,000 legal bill with Shawn Holley," Michael Lohan says.

Michael also says that he is the one who approached Holley to structure the home arrest for Lindsay.

"I met with a DA friend of mine and they suggested this plan of action," he said.

Despite his relief that Lindsay may only be subjected to house arrest, the probation report stating that Lindsay tested positive for alcohol on February 8, 2011 didn’t surprise Michael.

"The last thing in the world I want is for my daughter to be in jail," he said. "At the same time, I am extremely concerned that there are some of the wrong people still in Lindsay's life and she knows it."

The judge ordered Lindsay to turn herself in to the jail for her 120 days on June 17. She’s already applied to have that sentence changed to house arrest, and is likely to be approved for it.

Levinson: Lohan Probably Out of ‘Gotti’ Project

Director Barry Levinson is rewriting the script to “Gotti” and his new version seems unlikely to include a role for Lindsay Lohan, he told TheWrap in Cannes on Thursday.

“I didn’t (cast her) and we’ll have to see how this all works out,” he said, when asked about Lohan, who was first cast by Nick Cassavetes.

“We haven’t clarified that,” he said, referring to the actress’s status. “She’s possibly not (in the film) because she’s got her issues, and we also got to write the script, and then we’ll see where it is. I got involved and said ‘I’ll do this, but the existing script doesn’t work for me.’"
